{"id":10,"date":"2024-11-19T14:38:50","date_gmt":"2024-11-19T13:38:50","guid":{"rendered":"http:\/\/plasilova.dnservis.cz\/?page_id=10"},"modified":"2024-11-22T11:53:32","modified_gmt":"2024-11-22T10:53:32","slug":"exekuce","status":"publish","type":"page","link":"https:\/\/www.exekutor-plasilova.cz\/index.php\/exekuce\/","title":{"rendered":"Exekuce"},"content":{"rendered":"\n<p><strong>Nespln\u00ed li povinn\u00fd dobrovoln\u011b, co mu ukl\u00e1d\u00e1 vykonateln\u00e9 rozhodnut\u00ed, (exeku\u010dn\u00ed titul), m\u016f\u017ee opr\u00e1vn\u011bn\u00fd podat n\u00e1vrh na na\u0159\u00edzen\u00ed exekuce.<\/strong><\/p>\n\n\n\n<p><strong>P\u0159edpoklady proveden\u00ed exekuce<\/strong><br>M\u00e1-li opr\u00e1vn\u011bn\u00fd vykonateln\u00fd <strong>exeku\u010dn\u00ed titul<\/strong> , a nespln\u00ed-li povinn\u00fd dobrovoln\u011b svoji povinnost<\/p>\n\n\n\n<p><strong>P\u0159ehled exeku\u010dn\u00edch titul\u016f<\/strong><br><strong>a)<\/strong> vykonateln\u00e9 rozhodnut\u00ed soudu nebo exekutora, pokud p\u0159izn\u00e1v\u00e1 pr\u00e1vo, zavazuje k povinnosti nebo postihuje majetek,<br><strong>b)<\/strong>&nbsp;vykonateln\u00e9 rozhodnut\u00ed soudu a jin\u00e9ho org\u00e1nu \u010dinn\u00e9ho v trestn\u00edm \u0159\u00edzen\u00ed, pokud p\u0159izn\u00e1v\u00e1 pr\u00e1vo nebo postihuje majetek,<br><strong>c)<\/strong>&nbsp;vykonateln\u00fd rozhod\u010d\u00ed n\u00e1lez,<br><strong>d)<\/strong>&nbsp;not\u00e1\u0159sk\u00fd z\u00e1pis se svolen\u00edm k vykonatelnosti sepsan\u00fd podle zvl\u00e1\u0161tn\u00edho pr\u00e1vn\u00edho p\u0159edpisu<br><strong>e)<\/strong>&nbsp;vykonateln\u00e9 rozhodnut\u00ed a jin\u00fd exeku\u010dn\u00ed titul org\u00e1nu ve\u0159ejn\u00e9 moci,<br><strong>f)<\/strong>&nbsp;jin\u00e1 vykonateln\u00e1 rozhodnut\u00ed a schv\u00e1len\u00e9 sm\u00edry a listiny, jejich\u017e v\u00fdkon p\u0159ipou\u0161t\u00ed z\u00e1kon.<\/p>\n\n\n\n<p>Neobsahuje-li exeku\u010dn\u00ed titul ur\u010den\u00ed lh\u016fty ke spln\u011bn\u00ed povinnosti, m\u00e1 se za to, \u017ee povinnosti ulo\u017een\u00e9 exeku\u010dn\u00edm titulem je t\u0159eba splnit do 3 dn\u016f a, jde-li o vyklizen\u00ed bytu, do 15 dn\u016f od pr\u00e1vn\u00ed moci rozhodnut\u00ed.<\/p>\n\n\n\n<p>Exekuci rozhodnut\u00ed soudu o prodeji z\u00e1stavy lze v\u00e9st tehdy, obsahuje-li ozna\u010den\u00ed opr\u00e1vn\u011bn\u00e9 a povinn\u00e9 osoby, z\u00e1stavy a v\u00fd\u0161i zaji\u0161t\u011bn\u00e9 pohled\u00e1vky a jej\u00edho p\u0159\u00edslu\u0161enstv\u00ed.<br><br><strong>N\u00e1vrh na na\u0159\u00edzen\u00ed exekuce<\/strong> pod\u00e1v\u00e1 opr\u00e1vn\u011bn\u00fd <strong>exekutorovi<\/strong><strong>.<\/strong>&nbsp; N\u00e1vrh m\u016f\u017ee podat&nbsp;<strong>kter\u00e9mukoliv exekutorovi, kter\u00e9ho si zvol\u00ed<\/strong>&nbsp;bez ohledu na m\u00edstn\u00ed p\u0159\u00edslu\u0161nost. N\u00e1vrh podan\u00fd soudu mus\u00ed obsahovat ur\u010den\u00ed konkr\u00e9tn\u00edho exekutora, kter\u00e9ho si opr\u00e1vn\u011bn\u00fd vybral. M\u00edstn\u011b a v\u011bcn\u011b p\u0159\u00edslu\u0161n\u00fdm exeku\u010dn\u00edm soudem je okresn\u00ed soud povinn\u00e9ho (p\u0159esn\u00e1 definice v \u00a7 45 exeku\u010dn\u00edho \u0159\u00e1du). N\u00e1vrh podan\u00fd exekutorovi mus\u00ed obsahovat:<br>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; \u2022 ozna\u010den\u00ed exekutora v\u010detn\u011b s\u00eddla,<br>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; \u2022 ozna\u010den\u00ed opr\u00e1vn\u011bn\u00e9ho a povinn\u00e9ho (jm\u00e9no a bydli\u0161t\u011b, resp. obchodn\u00ed jm\u00e9no, s\u00eddlo a I\u010cO)<br>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; \u2022 exeku\u010dn\u00ed titul \u2013 p\u0159esn\u00e9 ozna\u010den\u00ed,<br>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; \u2022 povinnost, kter\u00e1 m\u00e1 b\u00fdt exekuc\u00ed vymo\u017eena a \u00fadaj, zda a v jak\u00e9m rozsahu byla ji\u017e povinn\u00fdm spln\u011bna,<br>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; \u2022 d\u016fkazy, kter\u00fdch se opr\u00e1vn\u011bn\u00fd dovol\u00e1v\u00e1,<br>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; \u2022 datum a podpis opr\u00e1vn\u011bn\u00e9ho.<\/p>\n\n\n\n<p>V n\u00e1vrhu na na\u0159\u00edzen\u00ed exekuce by m\u011bly b\u00fdt uvedeny i dal\u0161\u00ed skute\u010dnosti, kter\u00e9 usnadn\u00ed proveden\u00ed exekuce (nap\u0159. \u00fadaje o majetku povinn\u00e9ho, m\u00e1-li b\u00fdt exekuc\u00ed posti\u017een, jeho pl\u00e1tci mzdy atd.), pokud tyto \u00fadaje opr\u00e1vn\u011bn\u00fd zn\u00e1.<br>P\u0159e\u0161lo-li pr\u00e1vo p\u0159iznan\u00e9 exeku\u010dn\u00edm titulem nebo naopak povinnost t\u00edmto titulem ulo\u017een\u00e1 na jinou osobu (postoupen\u00ed pohled\u00e1vky, d\u011bdictv\u00ed, p\u0159evzet\u00ed z\u00e1vazku \u2026), je t\u0159eba dolo\u017eit tuto skute\u010dnost listinou vydanou anebo ov\u011b\u0159enou st\u00e1tn\u00edm org\u00e1nem nebo not\u00e1\u0159em.<br>Na rozd\u00edl od dosavadn\u00ed \u00fapravy exekuce vykon\u00e1van\u00e9 soudem&nbsp;<strong>opr\u00e1vn\u011bn\u00fd nemus\u00ed v n\u00e1vrhu ur\u010dovat, jak\u00fdm zp\u016fsobem m\u00e1 b\u00fdt exekuce provedena<\/strong>&nbsp;(nemus\u00ed nap\u0159. bezpodm\u00edne\u010dn\u011b ozna\u010dovat majetek povinn\u00e9ho, kter\u00fd m\u00e1 b\u00fdt exekuc\u00ed posti\u017een)<\/p>\n\n\n\n<p>K n\u00e1vrhu na na\u0159\u00edzen\u00ed exekuce je&nbsp;<strong>vhodn\u00e9 p\u0159ipojit krom\u011b exeku\u010dn\u00edho titulu i dal\u0161\u00ed listiny<\/strong>, kter\u00e9 sv\u011bd\u010d\u00ed o skute\u010dnostech v\u00fdznamn\u00fdch pro proveden\u00ed exekuce, zejm\u00e9na o majetku povinn\u00e9ho, m\u00e1-li b\u00fdt exekuc\u00ed posti\u017een (v\u00fdpisy z katastru nemovitost\u00ed, st\u0159ediska cenn\u00fdch pap\u00edr\u016f\u2026) \u2013 viz Vzor n\u00e1vrhu na na\u0159\u00edzen\u00ed exekuce.<\/p>\n\n\n\n<p><strong>Exekutor<\/strong>, kter\u00e9mu byl pod\u00e1n n\u00e1vrh, postupuje d\u00e1le z \u00fa\u0159edn\u00ed povinnosti \u2013 do 15 dn\u016f<strong>\u00a0po\u017e\u00e1d\u00e1 soud o ud\u011blen\u00ed pov\u011b\u0159en\u00ed k proveden\u00ed exekuce<\/strong> Soud vyd\u00e1 pov\u011b\u0159en\u00ed do 15 dn\u016f. Nejpozd\u011bji do 15 dn\u016f ode dne doru\u010den\u00ed pov\u011b\u0159en\u00ed podle \u00a7 43a odst. 3 za\u0161le exekutor opr\u00e1vn\u011bn\u00e9mu vyrozum\u011bn\u00ed o zah\u00e1jen\u00ed exekuce. Povinn\u00e9mu za\u0161le exekutor vyrozum\u011bn\u00ed nejpozd\u011bji s prvn\u00edm exeku\u010dn\u00edm p\u0159\u00edkazem, kter\u00fd mu v exeku\u010dn\u00edm \u0159\u00edzen\u00ed doru\u010duje; spolu s vyrozum\u011bn\u00edm za\u0161le exekutor povinn\u00e9mu exeku\u010dn\u00ed n\u00e1vrh, kopii exeku\u010dn\u00edho titulu a v\u00fdzvu podle \u00a7 46 odst. 6.\u00a0<br>Exekutor pot\u00e9, co byla exekuce zaps\u00e1na do rejst\u0159\u00edku zah\u00e1jen\u00fdch exekuc\u00ed, posoud\u00ed, jak\u00fdm zp\u016fsobem bude exekuce provedena, a vyd\u00e1 nebo zru\u0161\u00ed exeku\u010dn\u00ed p\u0159\u00edkaz ohledn\u011b majetku, kter\u00fd m\u00e1 b\u00fdt exekuc\u00ed posti\u017een. Exeku\u010dn\u00edm p\u0159\u00edkazem se rozum\u00ed p\u0159\u00edkaz k proveden\u00ed exekuce n\u011bkter\u00fdm ze zp\u016fsob\u016f uveden\u00fdch v z\u00e1kon\u011b. Exekutor je povinen v exeku\u010dn\u00edm p\u0159\u00edkazu zvolit takov\u00fd zp\u016fsob exekuce, kter\u00fd nen\u00ed z\u0159ejm\u011b nevhodn\u00fd, zejm\u00e9na vzhledem k nepom\u011bru v\u00fd\u0161e dluh\u016f povinn\u00e9ho a ceny p\u0159edm\u011btu, z n\u011bho\u017e m\u00e1 b\u00fdt spln\u011bn\u00ed dluh\u016f povinn\u00e9ho dosa\u017eeno.<br>Exekutor m\u016f\u017ee vyzvat opr\u00e1vn\u011bn\u00e9ho, aby navrhl, jak\u00fdm zp\u016fsobem m\u00e1 b\u00fdt exekuce provedena.<br><br><strong>N\u00e1klady exekuce<\/strong>, mezi n\u011b\u017e pat\u0159\u00ed zejm\u00e9na odm\u011bna exekutora, n\u00e1hrada hotov\u00fdch v\u00fddaj\u016f a n\u00e1hrada za doru\u010den\u00ed p\u00edsemnost\u00ed,\u00a0<strong>hrad\u00ed povinn\u00fd<\/strong>. V\u00fd\u0161i a zp\u016fsob ur\u010den\u00ed odm\u011bny exekutora, hotov\u00fdch v\u00fddaj\u016f atd. upravuje vyhl\u00e1\u0161ka \u010d. 330\/2001 Sb. U exekuce na zaplacen\u00ed pen\u011b\u017eit\u00e9 \u010d\u00e1stky \u010din\u00ed\u00a0<strong>odm\u011bna exekutora 15 % z vymo\u017een\u00e9 \u010d\u00e1stky<\/strong>\u00a0(minim\u00e1ln\u011b 2.000,- K\u010d u exeku\u010dn\u00edch \u0159\u00edzen\u00ed zah\u00e1jen\u00fdch od 1.4.2017), a to do \u010d\u00e1stky 3.000.000,- K\u010d, p\u0159i vy\u0161\u0161\u00ed \u010d\u00e1stce percentu\u00e1ln\u011b kles\u00e1. Exekutor a opr\u00e1vn\u011bn\u00fd mohou uzav\u0159\u00edt p\u00edsemnou smlouvu, kterou se sjedn\u00e1v\u00e1 smluvn\u00ed odm\u011bna za proveden\u00ed exekuce nad r\u00e1mec tarifn\u00ed odm\u011bny stanoven\u00e9 vyhl\u00e1\u0161kou. Smluvn\u00ed odm\u011bna nen\u00ed n\u00e1kladem exekuce.<br><br>Exekutor m\u016f\u017ee po\u00a0<strong>opr\u00e1vn\u011bn\u00e9m po\u017eadovat slo\u017een\u00ed z\u00e1lohy na n\u00e1klady exekuce<\/strong>\u00a0(max. do 50 % tarifn\u00ed odm\u011bny u exekuce na zaplacen\u00ed pen\u011b\u017eit\u00e9 \u010d\u00e1stky).<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Nespln\u00ed li povinn\u00fd dobrovoln\u011b, co mu ukl\u00e1d\u00e1 vykonateln\u00e9 rozhodnut\u00ed, (exeku\u010dn\u00ed titul), m\u016f\u017ee opr\u00e1vn\u011bn\u00fd podat n\u00e1vrh na na\u0159\u00edzen\u00ed exekuce.
